More than seven million Californians voted in 2008 for Proposition 8, a state constitutional amendment that defines marriage as the union of a man and a woman. Those voters are all guilty of hate against homosexuals—at least according to a federal lawsuit to overthrow Prop 8.
The lawsuit, which will likely wind up in the Supreme Court, argues that since there is no rational basis to limit marriage to members of the opposite sex, animus (or hate) must be the motivating factor.
One of the attorneys bringing the case has argued that the definition of traditional marriage is nothing but the “residue of centuries of figurative and literal gay bashing.”
That, of course, is nonsense. But it’s also clever legal strategy, since Anthony Kennedy once ruled in a Supreme Court decision that a ban on special rights for homosexuals in Colorado had no rational basis and was “born of animosity.”
But perhaps Anthony Kennedy’s ability to see a rational basis should not be the standard here. He is, after all, the most famous waffler on the Court, and on any given day might not be able to see a rational basis for having breakfast.
In reality, the rational basis for traditional marriage is abundant. It was designed by God, our biology makes that clear to all but the most obtuse, and studies show it provides the best environment for raising healthy children.
The only “animus” here is between homosexual activists and the truth.
